Deviating terms and conditions of the customer are not recognised unless we expressly agree to them in writing.<\/p>\n<h3>2. scope of services<\/h3>\n<p>We offer professional services in the field of:<\/p>\n<ul>\n<li>Building Cleaning<\/li>\n<li>Stairwell Cleaning<\/li>\n<li>Maintenance &amp; office cleaning<\/li>\n<li>Building cleaning (rough and fine)<\/li>\n<li>Post-Move or Renovation Cleaning<\/li>\n<li>Clearing out<\/li>\n<li>Event cleaning (cleaning before, during and after events)<\/li>\n<li>Property management service<\/li>\n<li>Winter road clearance &amp; traffic safety<\/li>\n<li>Garden care &amp; outdoor areas<\/li>\n<li>Furniture and removal service<\/li>\n<li>Security &amp; parking service (event security and parking management pursuant to \u00a7 34a GewO)<\/li>\n<\/ul>\n<p>The specific scope of services, schedule and price are agreed individually before the start of the order and recorded in writing (by e-mail or booking confirmation).<\/p>\n<h3>3. conclusion of contract<\/h3>\n<p>A contract is concluded by:<\/p>\n<ul>\n<li>Your booking enquiry (online, by telephone or in writing)<\/li>\n<li>Our written confirmation (e-mail with booking confirmation)<\/li>\n<\/ul>\n<p>We reserve the right to refuse booking enquiries without giving reasons. There is no entitlement to the conclusion of a contract.<\/p>\n<h3>4 Prices and payment<\/h3>\n<p><strong>4.1 Prices<\/strong><br \/>\nAll prices are subject to value added tax (VAT), unless expressly stated as gross prices.<\/p>\n<p><strong>4.2 Terms of payment<\/strong><br \/>\nFor private customers: Payment after service provision by bank transfer or in cash.<br \/>\nFor entrepreneurs: Payment within 14 days of invoicing without deduction.<\/p>\n<p><strong>4.3 Advance payments<\/strong><br \/>\nFor larger projects (&gt; \u20ac500) we may require an agreed deposit.<\/p>\n<h3>5 Dates and cancellation<\/h3>\n<p><strong>5.1 Confirmation of appointment<\/strong><br \/>\nBooking dates are confirmed within 24-48 hours of enquiry. Confirmation will be sent by e-mail or SMS.<\/p>\n<p><strong>5.2 Cancellation by customers<\/strong><br \/>\nCancellations are possible free of charge until:<\/p>\n<ul>\n<li>24 hours before the appointment for standard services<\/li>\n<li>72 hours before the deadline for major projects (&gt; \u20ac1000)<\/li>\n<\/ul>\n<p>In the event of later cancellations, we reserve the right to charge 50% of the agreed price as a cancellation fee.<\/p>\n<p><strong>5.3 Cancellation by us<\/strong><br \/>\nWe can postpone or cancel appointments in the event of<\/p>\n<ul>\n<li>Staff illness<\/li>\n<li>Severe weather or other force majeure<\/li>\n<li>Unavailability of the customer on the agreed date<\/li>\n<\/ul>\n<p>In these cases, a new appointment will be arranged free of charge.<\/p>\n<h3>6. warranty<\/h3>\n<p><strong>6.1 Complaint<\/strong><br \/>\nComplaints must be made within <strong>24 hours<\/strong> in writing (e-mail) to privacy@lmc-services.de after the service has been provided.<\/p>\n<p><strong>6.2 Warranty periods<\/strong><\/p>\n<ul>\n<li><strong>Private customers (consumers):<\/strong> 2-year warranty according to \u00a7 437 BGB<\/li>\n<li><strong>Entrepreneur:<\/strong> 1 year warranty<\/li>\n<\/ul>\n<p><strong>6.3 Rework<\/strong><br \/>\nIn the event of justified complaints, we will rectify the defect within 7 days or grant an appropriate price reduction.<\/p>\n<p><strong>6.4 Exclusions<\/strong><br \/>\nExcluded from the warranty are<\/p>\n<ul>\n<li>Wear and tear or existing damage that existed before the commencement of benefits<\/li>\n<li>Damage due to improper use by the customer<\/li>\n<li>Normal soiling between cleaning intervals<\/li>\n<\/ul>\n<h3>7. liability<\/h3>\n<p><strong>7.1 General liability<\/strong><br \/>\nWe are only liable for damages in the event of:<\/p>\n<ul>\n<li>Prefix<\/li>\n<li>Gross negligence<\/li>\n<li>Breach of material contractual obligations (cardinal obligations)<\/li>\n<\/ul>\n<p><strong>7.2 Limitation of liability<\/strong><br \/>\nLiability for slight negligence is limited to foreseeable damage typical of the contract.<\/p>\n<p><strong>7.3 Insurance<\/strong><br \/>\nAll work is covered by public liability insurance.<\/p>\n<p><strong>7.4 Exclusion<\/strong><br \/>\nNo liability for:<\/p>\n<ul>\n<li>Valuables (jewellery, cash) - please secure before the start of the service<\/li>\n<li>sensitive or non-standard surfaces without prior consultation<\/li>\n<li>Damage due to undisclosed hazards (e.g. defective electrical appliances)<\/li>\n<\/ul>\n<h3>8. data protection and cookies<\/h3>\n<p>By using our website and booking our services, you accept our terms and conditions. <a href=\"\/en\/datenschutz\/\">Privacy policy<\/a>.<\/p>\n<ul>\n<li>Cookies are only set with express consent (GDPR\/TTDSG)<\/li>\n<li>Personal data is only processed for the fulfilment of the contract<\/li>\n<li>Consent can be revoked at any time<\/li>\n<\/ul>\n<p>Our Consent Management Platform: <a href=\"https:\/\/complianz.io\" target=\"_blank\" rel=\"noopener noreferrer\">Compliance<\/a><\/p>\n<h3>9 Intellectual property<\/h3>\n<p>All contents of this website (texts, images, logos) are protected by copyright. Any use, reproduction or distribution without express written authorisation is prohibited.<\/p>\n<h3>10. right of cancellation (consumer)<\/h3>\n<p>Consumers have a 14-day right of cancellation for distance selling contracts. For details see <a href=\"\/en\/widerruf\/\">Cancellation policy<\/a>.<\/p>\n<p><strong>Exception:<\/strong> The right of cancellation shall expire prematurely if you expressly agree that we may commence performance before the expiry of the cancellation period.<\/p>\n<h3>11. final provisions<\/h3>\n<p><strong>11.1 Applicable law<\/strong><br \/>\nThe law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).<\/p>\n<p>For consumers, the law of their habitual residence also applies (Art. 6 Rome I Regulation).<\/p>\n<p><strong>11.2 Place of jurisdiction<\/strong><br \/>\nThe place of jurisdiction for all disputes is the court responsible for the registered office of our company in Hesse, provided that you are a merchant, a legal entity under public law or a special fund under public law.<\/p>\n<p>For consumers, the place of jurisdiction is their place of residence (\u00a7 13 ZPO).<\/p>\n<p><strong>11.3 EU dispute resolution<\/strong><br \/>\nThe EU Commission provides a platform for online dispute resolution:<br \/>\n<a href=\"https:\/\/ec.europa.eu\/consumers\/odr\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/ec.europa.eu\/consumers\/odr<\/a><\/p>\n<p>We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.<\/p>\n<p><strong>11.4 Severability clause<\/strong><br \/>\nShould individual provisions of these GTC be invalid, the remainder of the contract shall remain valid. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.<\/p>\n<p><strong>11.5 Changes<\/strong><br \/>\nAmendments to these GTC must be made in writing.
